Terms and Conditions

Welcome to Scaleboard.
These Terms and Conditions ("Terms") govern your access to and use of the Scaleboard platform, website, mobile applications, and related services (collectively, the “Service”) operated by Scaleboard Technologies Pvt. Ltd. (“Scaleboard,” “we,” “our,” or “us”).By accessing or using Scaleboard, you agree to be bound by these Terms. If you do not agree, do not access or use the Service.

1. Eligibility

You must be at least 18 years old and capable of entering into a binding contract under applicable law to use the Service. By using Scaleboard, you represent and warrant that you meet these requirements.

2. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.

  • Maintain and promptly update your account information.

  • Be responsible for safeguarding your login credentials and all activities under your account.

Scaleboard is not liable for any loss or damage arising from unauthorized access to your account.

3. Use of the Service

You may use Scaleboard only for lawful business purposes and in accordance with these Terms. You agree not to:

  • Copy, modify, or create derivative works of the Service.

  • Reverse-engineer, decompile, or disassemble any part of the Service.

  • Access or use the Service to build a competing product.

  • Transmit malicious code, spam, or other harmful content.

  • Violate any applicable laws or regulations in connection with your use of the Service.

Scaleboard reserves the right to suspend or terminate your access if you violate these Terms.

4. Subscription and Payment

Some features of Scaleboard may require a paid subscription. By purchasing a subscription, you agree to pay the applicable fees as described at the time of purchase.

  • All payments are non-refundable except as required by law or as outlined in our refund policy.

  • Subscription plans renew automatically unless canceled before the renewal date.

  • You may cancel your subscription at any time through your account settings.

Scaleboard may modify pricing or plans with prior notice.

5. Intellectual Property

All rights, titles, and interests in and to the Service, including software, design, text, graphics, and trademarks, are owned by Scaleboard or its licensors. You retain ownership of the content and data you upload to Scaleboard (“Your Content”). By uploading Your Content, you grant Scaleboard a limited, non-exclusive, and revocable license to host, display, and process it solely for providing the Service.

6. Data Privacy

Your privacy is important to us. Our collection, use, and disclosure of personal information are governed by our Privacy Policy, which forms part of these Terms. By using Scaleboard, you consent to such processing and warrant that all data provided by you is accurate and lawful.

7. Third-Party Services

Scaleboard may integrate with or provide links to third-party tools or services. We are not responsible for the content, privacy policies, or practices of such third parties. Your use of third-party services is governed by their respective terms.

8. Availability and Modifications

We strive to keep Scaleboard available and secure, but we do not guarantee uninterrupted or error-free operation. Scaleboard may modify, suspend, or discontinue any part of the Service at any time without prior notice.

9. Termination

You may stop using the Service at any time. Scaleboard may suspend or terminate your account if:

  • You violate these Terms, or

  • Continued use would cause harm or legal liability to Scaleboard or others.

Upon termination, your right to access the Service will immediately cease. Some obligations (e.g., payment, confidentiality, IP ownership) will survive termination.

10. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, express or implied. Scaleboard does not warrant that the Service will be uninterrupted, error-free, secure, or meet your expectations.

11. Limitation of Liability

To the fullest extent permitted by law, Scaleboard shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Scaleboard’s total aggregate liability arising out of or related to these Terms shall not exceed the amount you paid (if any) for the Service during the preceding 12 months.

 

12. Indemnification

You agree to indemnify and hold harmless Scaleboard, its affiliates, and their respective officers, employees, and agents from and against any claims, liabilities, damages, or expenses arising from:

  • Your use of the Service,

  • Your violation of these Terms, or

  • Your infringement of any third-party rights.

 

13. Governing Law and Dispute Resolution

 

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.

14. Changes to These Terms

 

We may update these Terms periodically. Any changes will be effective upon posting on this page, with the “Last Updated” date revised accordingly. Continued use of the Service after such updates constitutes acceptance of the revised Terms.
